Congress leader Rahul Gandhi has been sentenced to two years imprisonment by a Surat court in a four-year-old criminal defamation case. However, he has also got bail immediately. The court has given Rahul Gandhi 30 days to appeal against the sentence in the higher court.

Legal experts said that a member of the House is not disqualified just by being proved guilty. Rahul will have to immediately appeal in the High Court i.e. Gujarat High Court and take a stay on the decision.

“Under the Representation of the People Act of 1951, there are several criteria to disqualify a member from the house. Such as if the MP of any house has been convicted of an offense for more than six years, or he has been convicted for some other sections such as section 153A (offence of promoting enmity between different groups on grounds of religion, etc., and acts prejudicial to the maintenance of harmony) or section 171F (offence relating to undue influence at election).”

Also, any person convicted of any offense not specified under the Representation of the People Act, 1951, who has been sentenced to imprisonment for more than two years, would be disqualified from the same day and six months before coming out. He will remain ineligible until the end of the year.

Congress President Mallikarjun Kharge said, “We were guessing about it. Rahul has also got bail. We will decide the future course of action according to the Constitution. The BJP points fingers at everyone except itself.”

Describing the BJP government as a dictator, the Congress chief claimed that Rahul Gandhi is exposing the dark deeds of the government, so the government is upset with him.

Priyanka Gandhi said that the entire machinery of the government is trying to suppress the voice of Rahul Gandhi. Priyanka said that her brother has never been afraid and will never be.

Delhi CM Arvind Kejriwal has termed the action taken against Rahul Gandhi as wrong. He said that a conspiracy is being hatched to eliminate non-BJP leaders and parties by prosecuting them.
